CACHE COUNTY TRIAL RESULT IN FAVOR OF PECK BAXTER CLIENT IN REAL ESTATE DISPUTE
At the conclusion of a recent trial, a Cache County Court found in favor of a Peck Baxter client who was seeking to enforce an agreement to dissolve a partnership and divide partnership assets. The general partner had previously refused to transfer real estate to our client that was valued at roughly $4.5 million. The defendants brought counterclaims against our client in response the action to enforce the agreement. The Court found that agreement at issue constituted a valid and enforceable contract between the parties and that the Defendant had breached the agreement by refusing to convey real property to our client. The Court ordered that the defendants immediately transfer the real estate. Defendant’s counterclaims were also dismissed with prejudice.
